'Wayleave' is an archaic term from the nineteenth century defined as 'a privilege enabling a person to cross another person’s land with infrastructure and with goods and chattels'. It has been applied to electricity rights because of the need to string electricity lines across land. Electricity is such a fundamental part of life that its supply is often taken for granted. In reality, the rights for electricity lines are arguably the weakest of all utilities, with the vast majority covered by wayleaves. Privatisation in the 1990s provided the opportunity to bolster wayleave rights, but it only led to a tinkering through primary legislation. The acceleration of telecommunications over the past twenty years has confused issues, with operators installing masts and adding apparatus to electricity lines. A large proportion of wayleaves are dealt with at local level, with little consistency. Coupled to this is the public concern that electricity lines have potentially serious health effects that continue to attract research and media interest. This book has been written for those involved in, or advising on, the use and development of land for transmission and distribution lines. As most people have only brief encounters with the electricity infrastructure, this guide will help to avoid the fear of the unknown. By setting out the main principles and procedures used and the relevant primary and secondary legislation in a clear and easy-to-follow way it will enable lawyers, surveyors, planners, architects, engineers and accountants to discuss the relevant issues with confidence.

The Electronic Communications Code (schedule 2 to the Telecommunications Act 1984) sets out the regime that governs the rights of electronic communications operators to install and maintain infrastructure on public and private land. The Code strikes a balance between the rights and interests of landowners and network operators. This consultation paper discusses the current law and set out a number of provisional proposals and options for reform. The paper considers all the main provisions of the current Code and areas highlighted for potential reform include: the rights of operators and landowners under the Code, and the position of third parties; operators' obligations under the Code and related regulations; the test applied to determine whether code rights are granted to an operator where a landowner objects; the measure of the financial award to be paid to the landowner where an operator is granted code rights; the appropriate forum for the resolution of disputes, and other procedural issues; the interaction between the Code and other statutory regimes. The Code applies throughout the UK. The Commission's focus is on the law in England and Wales, but the project is being conducted in consultation with the Scottish and Northern Irish Law Commissions.

Agricultural Valuations, now in its fourth edition, is written by a practising agricultural valuer who has been working in property for over fifty years. His analysis updates recent changes to tenant right valuations, improvements, fixtures, milk quotas and dilapidations. The author uses numerous example claims and valuations which shed light on recent pipeline and electricity line wayleave claims, notices to remedy breaches, together with probate, income tax and compulsory purchase valuations. Further chapters deal with the guiding principles of how to correctly value farms, assess farm rents, carry out arbitrations, inventories and records of condition, valuation clauses on sales of farms, livestock, soils, management agreements, valuation in court proceedings and a glossary of useful information. This practical, but detailed book will be invaluable to students, agricultural valuers and land agents who are looking to be kept apprised of up to date best practices. The author was awarded the 'Kenneth Glenny' Prize by the Central Association of Agricultural Valuers when the first edition was published in 1984.
