This new volume presents a wealth of fresh data documenting and analyzing the different positions taken by governments in the development of the European Constitution. It examines how such decisions have substantial effects on the sovereignty of nation states and on the lives of citizens, independent of the ratification of a constitution. Few efforts have been made to document constitution building in a systematic and comparative manner, including the different steps and stages of this process. This book examines European Constitution-building by tracing the two-level policy formation process from the draft proposal of the European Convention until the Intergovernmental Conference, which finally adopted the document on the Constitution in June 2004. Following a tight comparative framework, it sheds light on reactions to the proposed constitution in the domestic arena of all the actors involved. It includes a chapter on each of the original ten member states and the fifteen accession states, plus key chapters on the European Commission and European Parliament. This book will be of strong interest to scholars and researchers of European Union politics, comparative politics, and policy-making.

Ever since its legal foundation in 1993 the European Union has been challenged by three concurring developments. Its decision making bodies were groaning under an increasing amount of legislative activity and pending Eastern enlargement was expected to further decrease law making efficiency. At the same time, European citizens grew increasingly wary towards EU politics and further integration. This book explains how European governments handled these challenges and, step-by-step, agreed on significant treaty reforms which eventually led to the signing of the Lisbon Treaty in December 2007. Drawing on unique survey data the book provides a solid empirical analysis of the three most important Intergovernmental Conferences. It shows in how far voters and political parties have been able to influence European treaty reforms and it scrutinises the mechanisms underlying intergovernmental treaty negotiations in an ever growing Union. The book discusses the domestic position formation process as well as the dynamics of intergovernmental bargaining. Ultimately, it explains European integration from Maastricht to Lisbon.

This volume offers a broad conceptual spectrum on the political and legal system of the European Union. The heuristic of multi-level governance relates to the multiple actors, the interconnectedness between levels of decision-making, and the interpenetration of institutions and actors. Additionally, legal sciences stress numerous legal centers, which, on the one hand, espouse independent legal orders, while communicating with each other through legislative acts, executive decisions, and court decrees on the other. The fusion of the legal and political aspects of the EU provides an opportunity to view the sui generis system of the EU in a broader perspective, which promises to overcome reductionist approaches, both in legal and political sciences. Parliaments risk becoming the main losers of internationalisation; a process that privileges executives and experts. Still, parliamentarians have developed a range of responses to catch up with international decision-making: they coordinate their actions with other parliamentarians; engage in international parliamentary forums; and some even opt to pursue political careers at the supranational level, such as in the European Parliament. This volume provides a thorough empirical examination of how an internationalising context drives parliamentarians to engage in inter-parliamentary coordination; how it affects their power positions vis-à-vis executive actors; among themselves; and in society in general. Furthermore, building upon these empirical insights, the book assesses whether parliamentary democracy can remain sustainable under these changing conditions. Indeed, if parliaments are, and remain, central to our understanding of modern democracy, it is of crucial importance to track their responses to internationalisation, the fragmentation of political sovereignty, and the proliferation of multilevel politics.

A new and wide-ranging empirical overview of party policy in 47 modern democracies, including all of the new democracies of Eastern Europe. It updates and radically extends Policy and Party Competition (1992), which established itself as a key mainstream data source for all political scientists exploring the policy positions of political parties. This essential text is divided into three clear parts: Part I introduces the study, themes and methodology Part II deals in depth with the wide range of issues involved in estimating and analyzing the policy positions of key political actors. Part III is the key data section that identifies key policy dimensions across the 47 countries, detailing their party positions and median legislators, and is complemented by graphical representations of each party system. This book is an invaluable reference for all political scientists, particularly those interested in party policy and comparative politics.

With almost a quarter of the world's migrants, Europe has been attempting to regulate migration and harmonize immigration policy at the European level. The central dilemma exposed is how liberal democracies can reconcile the need to control the movement of people with the desire to promote open borders, free markets and liberal standards. Gallya Lahav's book traces ten years of public opinion and elite attitudes toward immigration cross-nationally to show how and why increasing EU integration may not necessarily lead to more open immigration outcomes. Empirical evidence reveals that support from both elite and public opinion has led to the adoption of restrictive immigration policies despite the requirements of open borders. Unique in bringing together original data on European legislators and national elites, longitudinal data on public opinion and institutional and policy analyses, this 2004 study provides an important insight into the processes of European integration, and globalization more broadly.

In ten years 80 per cent of the legislation related to economics, maybe also to taxes and social aff airs, will be of Community origin.” This declaration has been largely quoted, paraphrased and deformed by different authors, creating a persistent myth according to which 80% of the legislative activity of the national legislatures would soon be reduced to the simple transposition of European norms”. This book addresses the topic of the scope and impact of Europeanization on national legislation, as a part of the Europeanization debate which raises normative concerns linked to the “democratic deficit” debate. The state of the art shows that there are many assumptions and claims on how European integration may affect national legislation and, more generally, domestic governance but that there is a lack of solid and comparative data to test them. The aim of the book is to give a solid and comparative insight into Europeanization focusing on effective outcomes in a systematic way. This book analyzes the period 1986-2008 and includes an introduction, a global overview of European legislative activities which set the background for Europeanization of national legislatures, 9 country contributions (8 EU member states + Switzerland) including systematic, comparative and standardized data, tables and figures, and a conclusion with a comparative analysis of the European and domestic reasons for Europeanization. All national contributions conclude that Europeanization of national legislation is much more limited than assumed in the literature and public debate. It is limited to 10 to 30% of laws (depending on the country), far less than the 80% predicted by Jacques Delors and mentioned daily by medias and public opinion leaders to demonstrate EU domination on member states. Beside that general statement, the various chapters propose a deep insight on EU constraint over national legislation, providing much information on the kind of laws and policies that are Europeanized, the evolution of this process through time, the impact of Europeanization on the balance of powers and the relations between majority and opposition at national level, the strategies developed by national institutions in that context, and many other issues, making the book of interest to academics and policy-makers concerned with Europeanization and national legislation.

The Politicization of Europe Author Paul Statham

This book examines how mass media debates have contributed to the politicization of the European Union. The public controversies over the EU’s attempted Constitution-making (and its failure) sowed the seeds for a process of politicization that has advanced ever since: an increasing visibility for the EU in mass-mediated public debates that is combined with a growing public contestation over Europe within national politics. The book presents an original systematic study of the emerging field of political discourse carried by the mass media in France, Germany and Britain to examine the performance of Europe’s public sphere. Whilst the EU’s increasing politicization can be seen as beneficial to European democracy, potentially ‘normalizing’ the EU-level within national politics, the same developments can also be a threat to democracy, leading to populist and xenophobic responses and a decline in political trust. Such discussions are key to understanding the EU’s legitimacy and how its democratic politics can work in an era of mediated politics. The Politicization of Europe will be of interest to students and scholars of comparative politics, media studies, communication, sociology and European studies.
