It has become a commonplace that there has been an information revolution, transforming both society and the economy. In 1995 the Trade Related Intellectual Property (TRIPs) agreement aimed to harmonise protection for property in knowledge throughout the global system. This book considers the contemporary disputes about the ownership of knowledge resources - as in the cases of genetically modified foods, the music industry or the internet - and the problematic nature of the TRIPs agreement. In this highly topical book, Christopher May reveals that, because of such problems, at present the balance in intellectual property rights between public good and private reward is more often than not weighted towards the latter.

The first edition established itself as one of the leading books to situate the issue of intellectual property within the discipline of International Political Economy (IPE). Since its publication, intellectual property has continued to rise up the global agenda, reflecting expanding interest in the area among policy-makers and advocacy groups, linked to the increasingly fraught politics of the global governance of IPRs. Significantly revised and updated to take account of developments within the World Trade Organization and the World Intellectual Property Organization, this edition incorporates the author’s recent research on IPRs. It retains the theoretical and analytical elements of the first edition, whilst offering students and researchers a detailed analysis of how intellectual property is politically constructed, and how it is linked to the economics of knowledge and information in the contemporary global political economy. Rapidly-developing issues addressed in the work include: arguments around the implementation of the Agreement on Trade Related Aspects of IPRs (TRIPs) the WIPO Development agenda and the ‘resistance’ to socialization programmes the AIDS crisis and the pharmaceutical industry Digital Rights Management This book will be of interest to students and researchers of international political economy, international relations and intellectual property law.

'This book is a substantial contribution to the discussion on trade-related intellectual property rights. It provides a clear, step-by-step, in-depth analysis of the TRIPS agreement, particularly as it relates to the European pharmaceutical industry. Politics, law and economics are judiciously blended. Meir Pugatch's work should be read not just by academic experts and students in the field, but also by trade policy and IPR practitioners interested in an accessible, policy-relevant treatment of the issues at hand.' - Razeen Sally, London School of Economics and Political Science, UK This book investigates the realm of intellectual property rights (IPRs) within the context of international political economy. In particular, it examines the extent to which powerful interest groups, such as pharmaceutical multinational companies, influence the political dynamism underlying the field of IPRs. Meir Perez Pugatch argues that a pure economic approach does not provide a sufficient or satisfactory explanation for the creation of intellectual property rights, most notably patents. The author instead suggests that a dynamic approach, based on the international political economy of interest groups and systemic outcomes, provides a better starting point for explaining how the international intellectual property agenda is determined.

Intellectual property rights and communications in Asia

Intellectual property rights and communications in Asia Author Pradip Thomas

RIGHT-WRONG; LEGAL-ILLEGAL. Such simple binary notions cannot be used to assess issues related to intellectual property and communications. One of te key dilemmas in the field of intellectual property rights today is the need for a system that rewards innovation and creativity while encouraging the social availability and distribution of ideas in the public domain. And this is the balance that this volume sets out to strike. With the ownership of IP becoming a core feature of media/information industries and state policy, issues related to access to knowledge and its use have become a matter of critical concern. While trade regimes, the state and the core cultural and information industries have begun to advocate greater scope for a variety of knowledge enclosures, civil society is increasingly arguing for a people-centred vision of knowledge futures. This vision includes the need for equity-based and flexible licensing regimes; the legitimacy of local solutions to IP-related issues; support for cultural diversity; and access to knowledge based on need rather than the ability to pay for knowledge. The central argument of this volume is that since access to knowledge in a knowledge economy is a passport to a better quality of life, then its fair distribution and universal availability ought to become a standard norm. The articles in this volume explore the contested nature of the ownership of and access to knowledge and support it with illustrative case studies from the Asian region. Exhaustively discussed from the point of view of the dominant ‘power’ interests as also the ‘margins’ (or indigenous communities), this volume provides emerging solutions supportive of public domain.

Seeking to extend our understanding of the contemporary global political economy, this book provides an important and original introduction to the current theoretical debates about social reproduction and argues for the necessity of linking social reproduction to specific contexts of power and production. It illustrates the analytic value of the concept of social reproduction through a series of case studies that examine the implications of how labor power is reproduced and how lives outside of work are lived. The issues examined in countries including the Ukraine, Chile, Spain, Nepal, India and Indonesia, consist of: Human trafficking and sex work Women and work Migration, labor and gender inequality Micro-credit programs and investing in women Health, biological reproduction and assisted reproductive technologies The book lends a unique perspective to the understandings of transformation in the global political economy precisely because of its simultaneous focus on the caring and provisioning of the everyday and its relationships to policies and decisions made at the national and international levels of both formal and informal institutions. With its multi-disciplinary approach, this book will be indispensable to students and scholars of International Political Economy, Development Studies, Gender or Women's Studies, International Studies, Globalization and International Relations.

This book offers a critical examination of the way in which the nature and governance of international labour migration is changing within a globalizing environment. It examines how labour mobility and the governance of labour migration are changing by exploring the links between political economy and differentiated forms of labour migration. Additionally, it considers the effects of new social models of inclusion and exclusion on labour migration. Therefore, the book troubles the conventional dichotomies and categorizations – permanent vs. temporary; skilled vs. unskilled; legal vs. illegal -- that have informed migration studies and regulatory frameworks. Theoretically, this volume contributes to an ongoing project of reframing the study of migration within politics and international relations. Bringing together an interdisciplinary group of scholars, drawing on examples from the European Union, North America and Asia, Governing International Labour Migration will be of interest to students and scholars of migration studies, IPE, international relations, and economics.
