Competition law is rooted in economic theory, and economics provides many of the standard tools often applied in competition investigations. As a result, a strong foundation in economics is an invaluable asset for practitioners in this area of law. This is the new edition of the popular and well-regarded practitioner guide to the economic principles of competition law. Written in accessible language for non-technical readers, it covers first economic principles by applying them directly to competition cases. It covers all major topics in competition law where economics is relevant: the core themes of market definition, market power and dominance, mergers, and anti-competition practice, as well as less familiar but important areas such as state aid, remedy design and damages. Topics are introduced by posing compelling questions based on real cases from around the world. The new edition has been updated to include important recent developments in competition law, and new economic approaches.

Sovereignty in the Shared Legal Order of the Eu

Sovereignty in the Shared Legal Order of the Eu Author Ton Van Den Brink

How does EU membership affect national sovereignty? This question has acquired a central place in the public debate on the European Union. National sovereignty relates to the independence of nation states in international affairs and to their autonomy to organize domestic matters. The European Union has challenged both, or so it has been perceived. In any case, such a view on sovereignty narrows the focus down to the question of national policy discretion. This edited volume offers a broader perspective on sovereignty relying on the international law concept. In addition to authority, this concept also includes citizenship and territory and assumes unity between these three elements. The focus is on the role of core values such as (representative) democracy, rule of law, justice, equality and economic stability in the process of shaping sovereignty in the shared legal order of the European Union. Moreover, not only the EU's power to regulate, but also issues of enforcement are addressed. Seven case-studies exploring 11 policy domains ranging from financial markets to social policy, and from administrative law to private law address two sub questions: how do core values define the relation between EU and national authority, citizenship and territory and how are conflicts between core values addressed within this shared legal order. Three cross-cutting studies on authority, citizenship, and territory identify common approaches and existing challenges. All 23 contributors of this volume work at the Utrecht Centre for Shared Regulation and Enforcement in Europe (RENFORCE).

Big Data and Competition Policy

Big Data and Big Analytics are a big deal today. Big Data is playing a pivotal role in many companies' strategic decision-making. Companies are striving to acquire a 'data advantage' over rivals. Data-driven mergers are increasing. These data-driven business strategies and mergers raise significant implications for privacy, consumer protection and competition law. At the same time, European and United States' competition authorities are beginning to consider the implications of a data-driven economy on competition policy. In 2015, the European Commission launched a competition inquiry into the e-commerce sector and issued a statement of objections in its Google investigation. The implications of Big Data on competition policy will likely be a part of the mix. Big Data and Competition Policy is the first work to offer a detailed description of the important new issue of Big Data and explains how it relates to competition laws and policy, both in the EU and US. The book helps bring the reader quickly up to speed on what is Big Data, its competitive implications, the competition authorities' approach to data-driven mergers and business strategies, and their current approach's strengths and weaknesses. Written by two recognized leading experts in competition law, this accessible work offers practical guidance and theoretical discussion of the potential benefits (including data-driven efficiencies) and concerns for the practitioner, policy maker, and academic alike.
